FAQs

Can I do my own Conveyancing in NSW?

Individuals are able to do their own conveyancing by purchasing Do-It-Yourself kits online which can be used as a guideline. However, we do not recommend conducting your own conveyancing for a number of reasons including the risk of fines or breaching your contract.
Doing your own conveyancing work poses many risks as you will not have the necessary legal knowledge regarding contracts, property sales and purchase to ensure that the contracts you are examining, do not have any legal loopholes, that will risk the possibility of you being fined or found to be in breach of you contract at a later date.

What is the difference between a Conveyancer and a Solicitor?

A solicitor with experience in conveyancing matters will have undergone training to become a qualified solicitor in NSW and is admitted to the Supreme Court of NSW. Conveyancing solicitors will have extensive knowledge on conveyancing but will also be well versed on other matters such as contract, taxation, and tort law.
To become a Conveyancer an individual must receive a Conveyancing licence by undergoing accredited courses such as a Diploma of Conveyancing. Their knowledge will be limited to conveyancing matters only, and therefore they will not be able to help should other legal issues arise.

Are Conveyancers cheaper than Solicitors?

Whilst conveyancers are often cheaper than solicitors, a solicitor’s higher price will usually be justified by the amount of experience, and additional knowledge they bring to the table when it comes to property matters.
Depending on the complexity of your conveyancing matter, it may be wiser for you to use a solicitor to handle your matter to ensure that you are protected against any legal issues or impediments that may arise when you are trying to settle.

How do I choose the right Solicitor or Conveyancer? Do I have to pay upfront?

Choosing the right agent for you depends on a number of factors including:
● Size of Property;● Complexity of proceedings; and● Experience of agent

Solicitor fees will generally be more expensive when compared to conveyancers but the additional cost will come with greater knowledge of property matters as well as the added ability to provide you with legal advice with respect to your matter.
A conveyancer may be the right option for you for a smaller property and/or a simpler matter but they will be limited to the work they will be able to provide you and not be able to give you any legal advice as to your matter.
Whilst both conveyancers and property solicitors will provide you with a cost estimate upfront, costs may be higher by the time you get to the end of your matter depending on any additional fees that may be incurred along the process.

Are online Conveyancers any good?

Whilst online conveyancing may be a more cost effective approach, online conveyancers are often plagued with large delays due to their extensive workload. As a result, your conveyancing matter may be faced with setbacks while the online Conveyancers attempt to remain on schedule or clear a backlog of work.
In addition to this, while online Conveyancers are enticing due to their lower fees, there are often several hidden costs that are added, meaning you will end up paying a higher fee than you originally expected.

How much does Conveyancing cost in NSW?

Conveyancing costs will range depending on a number of factors including the type of property in question and the complexity of the matter. To ensure that you get the correct cost for your specific matter, we recommend getting a quote from a qualified Solicitor or Conveyancer such as the team at Alan Rigas Solicitors.
